A cigarette license or a retail cigarette license is a legal document issued by the concerned state department (as well as City and county local bodies) which signifies that a business or a retailer is legally allowed to sell cigarettes and tobacco (against tobacco license) in accordance with the state law from a specified location to the consumers who are allowed to buy them.
Generally, the following information is asked by a business owner before issue a retail cigarette and tobacco license:

Carrying renewed retail cigarette and tobacco licenses and sales tax permit is mandatory to sell any tobacco items in the state of New York. Certificate of Authority and Retail cigarette license must be displayed at location prominently.

Generally, the following information are asked by a business owner before issue a retail cigarette and tobacco license:

  1. Proof of business name registration
  2. Sales and Use tax license which is also called a certificate of authority
  3. Some states require surety bonds
  4. Personal information such as all owners names, social security numbers, home addresses, height, color,  eye color and id copies.
  5. Tobacco permit is generally applied to the state, city and county.
  6. Liquor products are not allowed to sell under a tobacco permit.
  7. One of the prerequisites to start selling tobacco product to an end user, register for the education and  training with the state. New York is one of those states which requires to complete a course to sell tobacco products.
  8. It is recommended to specify a detail of the tobacco items you are planning to sell from the location in order to avoid any violation of the state and city laws, such as cigarettes, tobacco, roll your own cigarette, smokeless tobacco, E-Liquid, Cigars, Vape Pen and E-Cigarettes.
  9. A cigarette and tobacco license is subject to renew with the state and city to show the existence of the business.
  10. Selling tobacco products without a valid permit is subject to a penalty and the license can be suspended by the authorities. A tobacco permit also authorizes a business owner to buy tobacco products from the suppliers and manufacturers to sell to the end user.

  1. Which state do do want to start? Some states do not require license to sell tobacco products and you just need to have a saller's permit.
  2. How do you want to want structure your business? Under your personal name or other than personal name? If other than personal than than you either have to create a dba/sole proprietor or incorporate as an LLC or a corporation.
  3. If your state require tobacco license then you have to register your business, sales tax and tobacco license.
