In most states every retailer, wholesale, distributor, importer and a manufacturer who sells cigarettes or tobacco products is required to obtain a retail cigarette and tobacco license. A tobacco license renewals in most states every year.

The requirement in each state to obtain a cigarette license may be different; like in New York, depends on each county; City and State Tobacco Licenses are required in Kings County whereas only State license is required to sell tobacco products.

Some states require to provide a security bond to sell cigarettes and some want fingerprints and background check. Each state has defined its own laws to secure a tobacco license.

When do you register a company in the USA?

A business name registration is only required if one is using a business name to advertise a business. In most states, personal name is not registered as an entity or a sole proprietorship.


Yes, you can register your company in the State of Florida, which is not required as we have mentioned it above, but certainly an option to limit your personal liability and shield your assets under the corporate structure, to obtain a local tobacco permit. You have the options to file for a sole proprietorship, corporation or a single member LLC as it is easy to form and takes minimal time to get registered.


DBA Registration Restrictions For A Non US Resident:

Only the US residents can file a dba or proprietorship.


Process To Get A Tobacco License In Florida:


You should contact the Florida Department of Business and Professional Regulation where you will be conducting your business operations for issuing a permit by filing Form 6024 as a cigarette exporter with a fee of $ 100. This license will allow you to sell tobacco products beyond the border of Florida.

You can then apply to the Alcohol, Tobacco, Tax and Trade Bureau TTB for a federal tobacco permit to export tobacco products outside the US. This permit is called Tobacco Export Warehouse Proprietor Permit and can be downloaded from TTB website.

This permit is required for all businesses that intends to sell tobacco products to a foreign country. In order to apply for the permit, you must complete a detailed application form TTB F 5200.3 along with following documents.

  • Personnel questionnaire for each officer, director, or stockholder of more than 10 percent of a corporation, LLC or partnership on form TTB F 5000.9

  • Power of attorney on form TTB F 5000.8

  • Signing Authority for Corporate and LLC Officials TTB F 5100.1

  • Surety bond on TTB F 5200.26.

  • Organizational documents such as Articles of Organization for LLC, Articles of Incorporation (for corporations), Partnership Agreement (for Partnerships), operating agreement, lease agreement.

  • Application for Employer Identification Number to be filed with IRS on form SS-4, if applicable.

Please note that applicable state and/or local requirements must also be met in addition to those for the Federal permit described above.

Can you obtain a OHIO permit to sell cigars only, from a mobile van at any Ohio only location I choose too. Eg. Moving from one location to another week to week?

Answer: Any retailer / seller selling other tobacco products that also includes cigars is required to register and obtain a license from the respective county auditor office in the State of Ohio where his business is situated.


If you are selling cigars by moving from one location to another, you have to file separate applications for a retail permit for each location as there is no discount available for operating from different locations.


Further, you have to pay the license fee for each location thorough separate applications which is $ 125 per location in many counties, however, it can be varied depending upon the respective county.
